
There is a difference between a birth defect and a birth injury. A birth defect can be caused by factors such as a genetic condition or toxic exposure inside the womb. A birth injury generally results from complications arising from the childbirth process. Such injuries include bruising, lacerations or forceps marks, internal bleeding, severe swelling of the scalp, breakage of small blood vessels in the eyes, fractures, facial paralysis, shoulder dystocia, brain damage, brachial palsy, and cerebral palsy.
The natural contractions and contortions that come with childbirth can be difficult on a small infant, and the potential for injury is always present. However, in some circumstances, there is some form of medical error or negligence which may have caused unnecessary harm to your child. Such acts include:
- Improper use of delivery aids such as forceps or vacuum extraction.
- Poor decision making related to childbirth complications such as oxygen deprivation, pelvic irregularities, abnormally large fetus, shoulder dystocia or prematurity.
- Exposure to certain dangerous chemicals, dangerous procedures or improper levels of medication.
